Suprema corte derruba argumento da tecnicalidade
A Suprema Corte dos EUA decidiu ontem que evidências obtidas por meio de buscas ilegais conduzidas pela polícia nem sempre devem ser rejeitadas pelos tribunais. Por 5 a 4, os ministros do Supremo Tribunal Federal americano rejeitaram as chamadas “tecnicalidades”, seguidamente invocadas pelos advogados para obter a anulação de processos.
No caso específico, um homem foi preso por porte de armas e drogas com base num mandado de prisão vencido meses antes. A Suprema Corte considerou que isso não eximiu o réu de culpa pelo crime cometido, colocando a Justiça acima de uma pequena irregularidade.
A sentença deixou claro que a decisão seria outra se houvesse violação da lei ou da Constituição de forma sistemática como instrumento cotidiano da ação policial.
A decisão da corte derrubou a regra de quase 100 anos, segundo a qual os juízes tinham de rejeitar evidências que haviam sido obtidas de forma imprópria.
